Terms & Conditions (the “Terms”) for ChilizX Green Weekend - Zero Trading Fees

Please note: Chiliz Tokens and Fan Tokens are not and shall not be construed as investment or financial products; they are a form of cryptoassets. Be aware that: (a) their value is volatile and may fluctuate widely (both up and down); (b) in many jurisdictions these types of assets are unregulated, but take into account that regulations for cryptoassets vary widely from place to place, and those may change, possibly affecting your legal rights or obligations; and (c) you may be liable for taxes on profits. Trading these assets entails significant risks, potentially resulting in a total loss of funds, and is not suitable for those under 18 or those without proper understanding. Consult a qualified advisor if necessary, and trade at your own risk. ETT (company that operates ChilizX) disclaims liability for any related loss or damage.

Campaign:

1. This Campaign is called “ChilizX Green Weekend - Zero Trading Fees” (the “Campaign”).
2. Entertainment Trading Technologies Ltd, a company incorporated under the laws of Seychelles, bearing company number 218014, having its registered address at Suite 202, 2nd Floor, Eden Plaza, Eden Island, Mahe, Seychelles (“ETT” or the “Promoter”) 

Eligibility and Participation:

3. The Campaign is open to participants who satisfy the conditions set out under the Clause 6 of the Terms. (“Participant(s)”/“You”/“Your”/“Yourself”).
4. The Campaign will run from 24/11/2023, 14:00 CET (the “Opening Date”) to 28/11/2023, 11:00 CET (the “Closing Date”). Anyone who attempts to participate following the Closing Date will not be eligible to participate and will not be considered. Notwithstanding the foregoing, the Promoter reserves the right, in its absolute discretion, to consider submissions made after the Closing Date.
5. The Campaign will be executed in the following manner:
   1. Online: Participants partake in the Campaign online, following instructions available on the Campaign platform or website.
6. To participate, you MUST:
   1. Be aged eighteen (18) or over.
   2. Accept these Terms (participating in the Campaign will be understood as your acceptance of these Terms).
   3. Comply with any additional entry requirements or conditions specified in the Campaign guidelines.
7. Prohibited Jurisdictions are any of the following jurisdictions: Afghanistan, Burundi, Central African Republic, Cuba, Democratic Republic of Congo, Guinea-Bissau, Iran, Iraq, Kosovo, Lebanon, Libya, Myanmar, North Korea, Russia, Somalia, South Sudan, Sudan, Syria, United Kingdom, United States, Venezuela, Yemen, Zimbabwe. This list may be amended at any time at Promoters’ sole discretion.

Entry Requirements and Limitations:

8. Only one (1) participation per Participant is permitted. Each Participant is limited to one (1) account. Any attempt to create multiple accounts or engage in the Campaign more than once may result in disqualification.
9. Participation in the Campaign is free, and no trading fees will be charged during the campaign period, from the Opening Date to the Closing Date, as specified in the Campaign guidelines.
10. In addition to these Terms & Conditions for the “ChilizX Green Weekend - Zero Trading Fees“ (the 'Campaign'), participants must also adhere to the General Terms & Conditions of ChilizX exchange, which govern all use of the exchange and its services. Both sets of terms apply concurrently, and in the event of any conflict or inconsistency between these Campaign Terms and the General Terms & Conditions of ChilizX, the latter shall prevail. Liability:

11. The Promoter accepts no responsibility whatsoever for any technical fault of any kind that might affect trading on the ChilizX exchange.
12. The Promoter shall not be held responsible for the non-fulfilment or partial fulfilment of any aspect of this Campaign in case the same is due to any third party.

Breach of Terms & Consequences

13. Should a Participant be found in violation of these Terms & Conditions or the General Terms & Conditions of the ChilizX exchange at any point in time, whether during or after the duration of the Campaign, ETT (Entertainment Trading Technologies Ltd), in its sole and absolute discretion, reserves the right to take appropriate legal and corrective measures.

Such measures may include, but are not limited to:

1. Immediate Disqualification: The Participant may be immediately disqualified from the Campaign or any other ongoing or future campaigns, contests, or promotional activities run by the Promoter.
2. Suspension or Termination of Account: The Participant's ChilizX account may be suspended or terminated, and any funds or assets held within may be subject to additional review and possible forfeiture.
3. Legal Action: The Promoter may pursue legal action against the Participant, seeking remedies, damages, or injunctions as deemed appropriate under applicable laws.
4. Other actions: the Promoter may take other actions as specified and detailed in the General Terms & Conditions of the ChilizX exchange.

Jurisdiction and Privacy:

14. These Terms shall be governed by the laws of Seychelles. Any disputes arising out of or in connection with these Terms and/or the Campaign shall be referred to the exclusive jurisdiction of the courts of Seychelles, and the Participants of the Campaign submit to the exclusive jurisdiction of the Seychellois courts and tribunals.
15. Any personal data supplied during the course of this Campaign may be passed on to third-party suppliers only insofar as required for the fulfillment of the Campaign, delivery of the Prize, and marketing purposes. The handling of personal data shall be strictly in accordance with the Promoter's privacy policy available at https://chiliz.zendesk.com/hc/en-us/articles/360013265239-Chiliz-net-Privacy-Policy. 

General provisions

16. The decision of the Promoter regarding any aspect of the Campaign and the Prize is final and binding, and no correspondence will be entered into about it.
17. Participants are deemed to have accepted and agreed to be bound by these Terms upon entry into the Campaign. The Promoter reserves, at its sole and absolute discretion, the right to, at any time, refuse entry, disqualify, or refuse participation to anyone in breach of these Terms and/or any applicable law.
18. If a Participant uses fraudulent methods or otherwise attempts to circumvent these Terms, such Participant shall be discarded at the sole discretion of the Promoter.
19. The Promoter reserves the right to hold void, cancel, suspend, or amend the Campaign at any time when it becomes necessary to do so.
20. Insofar as is permitted by law, the Promoter, its agents or distributors will not in any circumstances be responsible or liable to compensate the Participants or accept any liability for any loss, damage, personal injury or death occurring as a result of taking up the Prize except where it is caused by the gross negligence of the Promoter, its agents or distributors or that of their employees. Your statutory rights are not affected.
21. By entering in the Campaign, participants accept and agree to participate in publicity material related to the Prize and this Campaign only, which may include the publication of the Winner’s name and images in any media  (including social media) both for Socios/Chiliz and any of the Promoter’s affiliates. The Winner/Participants may be required to participate in promotional filming of the Campaign during the Prize experience. Such filmed content may be used by the Promoter and its affiliates. All rights, including image and property rights, arising from the creation of any film material or content shall remain the sole property of the promoter and its affiliates.

A kind reminder that any personal data provided by participants in the ChilizX fee-free trading campaign shall be processed strictly in accordance with the Promoter's privacy policy available from https://chiliz.zendesk.com/hc/en-us/articles/360013265239-Chiliz-net-Privacy-Policy.

Nevertheless, we want to inform you that you have the right to be informed in a clear, transparent, and understandable way how we use your personal data in connection with the ChilizX fee-free trading campaign; request access to your personal information; request rectification of the personal data that we hold about you; request the erasure of your personal data; object to the processing of your personal data where we are relying on legitimate interest; request the restriction of processing of your personal data; request the transfer of your personal data to another party where you provided it to us, and we are using it based on your consent; withdraw consent at any time by sending an email to chiliz.dpo@ecija.com; and lodge a complaint before the suitable Supervisory Authority in Seychelles if you think that we are using your information in a way which breaches Data Protection Laws.
